In reply to your request you are to inform Earl Granville that Lord Derby would suggest that the Hang of Hong Kong should be told that the Extradition Acts of 1890 & 1893 do not apply to China; that the Treaty of Tientsin does not prescribe the manner in which the question of proof of guilt required by Art. XXI is to be ascertained; that sec. 3 of the Order to which the Marquis refers, empowers the Magistrate, if there appear to him to be probable cause for believing the person to have committed the offence, to commit him to prison until the gaoler shall receive some order from the Governor relative to the further detention or transmission of such person to the Chinese authorities; that the Governor before deciding to discharge the prisoner already committed by the Magistrate, would naturally consult with his Council.
