The Law Officer's opinion on this case (last para. of opinion, enclosed in 16750) was "not free from doubt", and they carefully abstained from saying anything as to the propriety of the direction contained in Lord Derby's telegram of 20 Nov. The instruction that "the proof of guilt should be such as on the whole to satisfy the minds of the Council" was, according to Marquis Tsêng's contention, contrary to the XXI section of the Treaty.
