In reply, I am to state to the Earl of Derby for his information, that the Portuguese government have been asked whether they are disposed to send Diay to Hong Kong for trial before the Supreme Court which has concurrent jurisdiction in the case, the crime charged having been committed on board a British ship and by one of the crew. They have also been informed that should they not be disposed to accede to this proposal, all the evidence available in Hongkong can be obtained by the judicial Authorities at Macao under a Commission issued for the purpose, and which would be executed in the Colony of Hong Kong under the Art. 19 and 20 Vict. C.115
