The words of this new Article XII shall be inserted under the proper heading where they are directed to be placed, in the Instrument of April 9, 1877, in like manner. Instructions December 8, 1883, are not in the Instrument of Appointment for Misses Constance Spratt; words justifying one Byrie and Jorwick, either.

Crime by description of the person entitled to be cited. In the then form, the Instructions of April 9, 1877, when amended as directed, are the Instrument of appointment. Say they do designate the case of persons to which Messrs Pyrie and Jorwick belong, and declare them to be members. And these Instructions being the Instrument of appointment, it would appear that inasmuch as six years have elapsed since the date, the tenures were vacant.

I pointed out that though this appeared to be the strict legal effect of the words of the Instructions, there was no doubt about what was the intention; but, as it happened, it was possible to act on the legal construction without seriously contravening.
