"With regard to the question which you submit to me whether it is desirable that the Justices of the Peace who are also paid officials of the Government, should abstain from taking part in the nomination of the Unofficial Member to be nominated by the Justices of the Peace, I concur with the opinion expressed by Mr. Johnson that this is a question which should not be left to be settled by a private understanding, but should be submitted to the Legislative Council for an expression of their opinion; and I request therefore, that you will bring it before that body.

2. There is no doubt whatsoever, but that the Council was unanimous in favour of the propriety of the official Justices abstaining from taking part in the nomination of an Unofficial Member,
