Certain promoters whose names are printed are empowered to assign any one or more of the tramways authorised to be constructed to any person, corporation, or company, and such person, corporation, or company may reassign the tramways to the promoters who may again assign them.
All and every the assignees for the time being are defined to be "the Company" within the power to make tramways and all the consequential powers are by 5 and subsequent sections given to the Promoters, not to the Company.
It can be seen that before the tramway can be made, there must be an assignment by the Promoters of tramways which do not exist on paper. May have no power to make such assignment.
I point this out and by that before the Ordinance is otherwise unobjectionable, I confirm it but point out that it offends in one unsubstantial way as it stands and report that the definition of the company should be altered to include the promoters.
