Governor or Senior Member to preside.

Governor to consult the Council except in specified cases.

VII. And We do further direct and appoint that Our said Governor do attend and preside at the meetings of Our said Executive Council, unless when prevented by some necessary and reasonable cause, and that in his absence the Senior Member of Our said Council present shall preside at all such meetings.

VIII. And We do further direct and enjoin that, in the execution of the several powers and authorities committed to Our said Governor by Our said Charter and Letters Patent constituting the office of Governor, he shall in all cases consult with Our said Executive Council, excepting only in cases which may be of such a nature that, in his judgment, Our service would sustain material prejudice by consulting Our said Executive Council thereon, or when the matters to be decided shall be too unimportant to require their advice, or too urgent to admit of their advice being given by the time within which it may be necessary for Our said Governor to act in respect of any such matters: Provided that in all such urgent cases Our said Governor shall, at the earliest practicable period, communicate to Our said Executive Council the measures which he may have so adopted, with the reasons thereof.

IV. And We do further declare Our pleasure to be, that in the event of the absence from Our said Colony of any such Official Member of the said Executive Council, Our said Governor may, by an Instrument under the Public Seal of Our said Colony, appoint any Public Officer to act provisionally as an Official Member of Our said Executive Council in the room of the said Member so absent as aforesaid and during his absence. And that every such provisional appointment may be disallowed by Us through one of Our Principal Secretaries of State, or may be revoked by Our said Governor by such Instrument as aforesaid.

V. And We do further direct and appoint that Our said Governor do forthwith communicate to Our said Executive Council these Our Instructions, and likewise all such others, from time to time, as he shall find convenient for Our service to be imparted to them.

VI. And We do further direct and appoint that Our said Executive Council shall not proceed to the dispatch of business unless duly summoned by the authority of Our said Governor, nor unless two Members at the least (exclusive of Our said Governor, or of the Member presiding), be present and assisting throughout the whole of the meetings at which any such business shall be dispatched.

IX. And We do further direct and appoint that no question shall be brought before Our said Executive Council for their advice or decision excepting only such questions as may be proposed by Our said Governor for that purpose: Provided nevertheless, that if any Member shall, by application in writing, request him so to propose any question, it shall be competent for any such Member to record upon the Minutes such his written application, together with the answer
