2. It appears that Mr. Justice Cowden had been in failing health for some time, but that it was only during the last few days that his illness threatened a fatal termination - a termination universally expected by the whole Community; and his loss is universally deplored -
It had acted for nine years as Puisne Judge, and had once filled temporarily the Office of Chief Justice of this Colony.
3. In the recommendation of the Chief Justice (Mr. George Phillippo), with the advice of the Executive Council, and subject to Your Lordship's approval, have appointed the Honourable James Nuvall, Colonial Treasurer and Registrar General, provisionally as the Puisne Judge of the Supreme Court. Mr. Russell is an English Barrister, and has acted temporarily on previous occasions in the same capacity, and also as Attorney General of this Colony.
