Sir,
I am instructed by my Board of Directors to inform you that
your letter of the 13th instant (receipt of which was acknowledged
on the 15th instant) has received their serious consideration and
they wish to draw attention to the following passages from their
letter of the 4th March 1942, vizt :
"My Board of Directors wish to point out in explanation "as to the conduct of Mr. Nathan in giving these undertakings "it is evident from the circumstances of the case that they "were given under 'force majeure'" and not voluntarily.
"... the Chief Managers of the K.M.A. could only make "the promise suggested by Colonel Yamashita with the approval "of the Owning Companies"
and
"... the pledge given regarding the K.M.A. staff remaining "at their posts after War has broken out is 'as long as none "of the Governments of the different nationals of which the "K.M.A. Staff is composed give contrary instructions'".
My Board of Directors are satisfied regarding the loyalty of
Mr. Nathan's intentions and actions in the matter.
The two documents in question were received in London in the
first week of December 1941, war was declared by Japan on the 7th
December 1941 and by Great Britain on the 8th December 1941, therefore my Board of Directors had no opportunity of taking any action or exerting any influence in the matter.
I am to add that my Board of Directors will be guided by the views expressed by the Foreign Office in this correspondence.
