Permit to bring in labourers in excess
of number prescribed
under sec- tion 12.
ALIENS.
(2) If, in any case where a limit has been prescribed under subsection (1), any alien, not being a transit passenger alien, shall be brought into and landed in the Colony in excess of such limit, such alien shall be deemed to have been brought into and landed in the Colony contrary to the provisions of this Ordinance.
13.--(1) Notwithstanding anything contained in section 12 or any Proclamation made thereunder, it shall be lawful for the Colonial Secretary in his absolute discretion to permit, on such terms and conditions as he may deem fit, any shipping company or charterer or owner of a ship, in respect of which a limit has been prescribed by Proclamation made under section 12 (1), to bring into and land in the Colony labourers recruited outside the Colony as authorized in the permit, if he is satisfied-
(a) that such labourers are actually required by a person or company by whom or on behalf of whom they have been recruited, provided that such person or company requires the labourers for work in the Colony or in a Malay State under His Majesty's protection; and
(b) that the admission of such labourers is not likely to be harmful to the public welfare of the Colony or of any Malay State under His Majesty's protection.
(2) Notwithstanding anything in this section or in any permit issued under this section, all the provisions of this Ordinance other than the provisions of section 12 or of any Proclamation made thereunder shall apply to all labourers landed in the Colony under a permit issued under this section.
(3) Where the place of employment is in a Malay State under His Majesty's protection no permit shall be given by the Colonial Secretary under this section without the consent of the Government of such Malay State.
(4) For the purposes of this section "labourer' shall mean a labourer as defined in section 3 of the Labour Ordinance (Chapter 69).
