The actual letter of appointment of Mr. Priestwood

is unfortunately not available, but Mr. Staines tells

me that he is fairly certain that it contained a paragraph

similar in terms to paragraph 16 of the revised letter

of appointment which it was proposed to issue to Mr.

Priestwood at the end of last year, the draft of which

can be found in K.11745/1701/210. If this is in fact

correct, then it is clear that the Secretary of State

can terminate Mr. Priestwood's appointment at any

moment by paying him three months' retaining fee in lieu

of notice. The procedure referred to by Sir W. Malkin

is that set forth in paragraphs 10 to 12 of the attached

printed memorandum (X 2896/297/504) of July 1st, 1935.

The right thing appears to be to instruct Sir A.

Clark Kerr to write to Sir A. Cadogan as directed in

paragraph 10 of the memorandum, and to communicate a

copy to Mr. Priestwood.

The letter to Mr. Priestwood in K 7476 shows that

his appointment is terminable at three months' notice.

This being so, I think it would be much better to make

use of this provision instead of dealing with the

matter as a disciplinary one under the procedure
