altogether be excluded and, given that you are prepared to

approve generally the terms of the enclosed Bill, I should

be grateful if consideration might be given to the question

of implementing these provisions, if necessary, by Imperial

legislation, having regard to the fact that the local

legislature has no power to legislate ex-territorially.

As is indicated above, enactment of the draft

legislation is contemplated only in the case of the

outbreak or extreme imminence of hostilities. I have not

included in the Bill provision for your prior consent to

enactment being obtained but I assume that such would be

the procedure. The Bill is expressed to come into

operation by Proclamation and to remain in force until

such Proclamation is cancelled by a subsequent order.
