emergency has arisen, by public notification declare that an emergency exists, and thereupon a state of emergency within the British Con- cession shall commence and continue until such time as His Britannic Majesty's Consul-General by public notification declares that the emergency has ceased to exist.

(2) During the continuance of a state of emergency the Municipal Council shall have power and authority from time to time to make, repeal, modify or otherwise vary Emergency Orders for the peace, order and good government, and for the better protection of the lives and property of persons within the British Concession: Provided always that no Emergency Order shall be valid unless and until the same has been approved by His Britannic Majesty's Consul- General.

(3) In such Emergency Orders the Municipal Council may assign penalties to be enforceable in the case of infringement of the same, and such penalties shall be enforceable in the same manner as the penalties attaching to infringement of the Council's Bye-laws.

(4) For the purpose of making, repealing, modifying or otherwise varying any such Emergency Order the Municipal Council shall be deemed to be duly formed by the presence of the number of members constituting the quorum ordinarily required for the despatch of business.

(5) Unless otherwise declared by the Municipal Council, an Emergency Order shall come into force immediately after publication thereof.

(6) No Emergency Order shall continue in force after the discontinuance of a state of emergency: Provided that the expiry of an Emergency Order shall not-

(a) Affect the operation thereof or anything duly done or suffered

thereunder; or

(b) Affect any right, privilege, exemption, obligation, or liability

acquired, accrued or incurred thereunder; or

(c) Affect any penalty or punishment incurred in respect of the

commission of any breach thereof; or

(d) Affect any investigation, legal proceeding, or remedy in respect of any such right, privilege, exemption, obligation, liability or punishment as aforesaid; and any such investi- gation, legal proceeding or remedy may be instituted, continued or enforced, and any such penalty or punishment may be imposed as if the Emergency Order had not expired.

2. These Regulations may be cited as "The Shameen Land Regulations (Amendment) Regulations, 1939."
