During the continuance of a state of emergency the
Municipal Council shall have power and authority from
time to time to make, repeal, modify or otherwise vary
Emergency Orders for the peace, order and good govern-
ment, and for the better protection of the lives and
property of persons within the British Concession:
ided always that no Emergency Order shall be valid un-
less and until the same has been approved by His Brit-
annic Majesty's Consul-General.
Prov-
In such Emergency Orders the Municipal Council may
assign penalties to be enforceable in the case of in-
fringement of the same, and such penalties shall be
́enforceable in the same manner as the penalties attach-
ing to infringement of the Council's Bye-laws.
For the purpose of making, repealing modifying or other-
wise varying any such Emergency Order the Municipal
Council shall be deemed to be duly formed by the pres❤
ence of the number of members constituting the quorum
ordinarily required for the despatch of business.
Unless otherwise declared by the Municipal Council, an
Emergency Order shall come into force immediately
after publication thereof.
No Emergency Order shall continue in force after the
dis continuance of a state of emergency : Provided that
the expiry of an Emergency Order shall not
(a) Affect the operation thereof or anything duly done
or suffered thereunder; Or
(b) Affect any right, privilege, exemption, obligation,
or liability acquired, accrued or incurred there- under;
Or
(c) Affect any penalty or punishment incurred in respect
of the commission of any breach thereof; or
(d) Affect any investigation, legal proceeding, or remedy
in respect of any such right, privilege, exemption, obligation, liability or punishment as aforesaid;
