Although the above draft King's Regulations would

only be directly bidning on British Subjects, they would, I

conceive, afford His Majesty's Consul-General and the Munic-

ipal Council a good defence against any legal action which

might be brought against them in respect of acts done in pursuance of the Regulations. At the present moment it

would seem that if either His Majesty's Consul-General or

the Council were to be sued in respect of acts done ultra

vires to the Land Regulations they might be held responsible

before the Courts to which they are amenable.

4. Whilst it is arguable that His Majesty's Consul-

General as agent for the Commissioners of His Majesty's

works and Public Buildings in whom the lease of the Concession

from the Chinese Government is vested, has the right to ex-

clude all unauthorized persons from entering the Concession

or storing goods thereon, this argument would, I consider,

fail in the case of persons who were either in possessi on

of a Crown Lease, or a sublease from a Crown Lessee, or who

might be held to be invitees of such tenants.
