I should be grateful if you would check with the Legal Advisers whether there is a requirement that members both of Legislative and Executive Councils should be British nationals. Sir Robert Black's letter at (53) on FED 364/400/01 Pt B speaks as if there is a nationality requirement for both Councils, whereas Sir David Trench's letter at E/51 (para. 3(ii)) says that it is not strictly necessary (and here Legislative Council only is in questio) that a member should be a British subject, although the precedent of appointing an alien might well prove embarrassing in future years.
