(g) Freedom of access to public service of a non-political character. There is no provision for -a non-political civil service. This requirement does not therefore appear to have

been met.

(h) Ineligibility of civil servants to simultaneous membership in the Volkstag. This is another requirement imposed by the Military Governors. It is contrary to German practice although some members of the Council claim to agree with it. At present, however, there is no doubt that the Basic Law provides for the contrary principle in Article 62. In this respect the requirement has been definitely rejected.
