unhesitatingly affirm and am prepared to prove to the satisfaction of the Executive Council, that

a. in making the communication which I did make to Per Johnson regarding der Haytlar Ewas4, I was not actuated by any bad animus against der Haytlar; that I was not compelled by any motive of self-interest but under repeated and urgent instructions of his Excellency the Governor; that I was acting in good faith, believing all that I stated to be true and necessary to be told in defence of his Excellency the Governor's interests; that I invented nothing but repeated what I understood the Governor to have told me and what I knew him to have told to others; that I said all that I did say in reply to questions pressed upon me, without volunteering any statement;

b. that in writing my letter of the 5th November to der Johnson, and in entering into communication with der Hayllar regarding withdrawal of the case Hayllar v. Eitel, and in making the retractations I did make about the withdrawal of that case, I was, from first to last, acting under the instructions and with the approval of his Excellency the Governor; that in allowing the case to be withdrawn I was sacrificing my own interests, which demanded a public inquiry, to the interests of his Excellency the Governor; and that having made this sacrifice I look to the confidential enquiry of the Executive Council to vindicate my conduct.
