Referring to my minute of May 25th on the preceding page, I think Mr. J. Pacale is entitled to have his pension calculated upon the Imperial Act of 1859, modified by subsequent Act Regulations and precedents, and that his figures will stand as follows:

Final award will be about $15,000 per year; and although the letter at once states that any deduction from his length of Service can be made on account of absences on much less leave than he has earned, the balances are in his favour.
Also, I do not think that any deduction from the pension can properly be made on the ground that during the years 1860 – 1866 he was entitled as Attorney General to practice his profession.
It has always been held that the holder of such an office was permitted to practice; and it has been decided that the fact of his having allowed other officers to receive pensions in respect of service in a similar capacity should not be taken into consideration.
