The Governor should be told
that

of the Pension Minute, must not
be held to debar Sir J. Smale from
the receipt of a judge's pension,
based on his Service
on the Bench, less
deduction for leave,

but that his previous service
as
Attorney General will not count
for pension purposes,
the Secretary
should be
Add that
of State does not
consider
that
any special pension
should be awarded
in this
case
(though he will not say that special pensions can never be awarded) when the services rendered to this retiring officer
are taken into account altogether
Governor should send home
a copy the paper of particulars
and the
calculation of the pension,
without
delay
Meanwhile, the
Secretary
of State
will authorise
the issue to
Sir J. Smale,
on
the
termination
