It appears to me that the papers show that the practice has been to obtain from the Chinese Authorities an assurance that the prisoners will not be subjected to torture, as a condition of the rendition, and that the Chinese Authorities have given such assurance in the present case.

That being, in my opinion, a proper condition for rendition, I do not think there is enough in the Consul's letter to warrant the Governor in refusing to give effect to this treaty in the present instance.
