3. As the insult on the occasion occurred under my own eye, the chastisement instantly followed. I was holding a little boy with my left hand, and with the right, in which I had an umbrella, I at once struck the assailant when he called out "Forgive Sir, I was mad: forgive me."

The umbrella, which was a slight one, was broken by the blow.

In his complaint to Your Lordship he entirely misstates what took place and he omits the material fact that, at the moment in question, he had insulted in my presence a lady of my family who had previously told me that this gentleman had been in the habit of following her into shops and annoying her on the public roads.

The whole affair, the insult to the lady and the prompt but not excessive chastisement that followed - did arise from his own misconduct.
