to be determined by the Court; the duties are

thus imposed under the

Ordinance upon this particular Office, not upon the Government.

I am of opinion that the

Government cannot be made legally responsible for

the wrongful

acts of the Registrar of the Supreme Court in his capacity as

Official

Assignee.

Assignee is an

Office

independent,

and the liability of the Government for the Registrar's

acts in that Office seems to be

neither more

nor less

than

it

would

be

for

that of

any

other person whom it appointed

to fill that post.

I think that the

same principle applies as in
