under the provisions of sec. 30
of 8 of 1860 it shall appertain to the Registrar.
By
The duties discharged
the Registrar in this capacity
are
the reference duties which
he is required by
Statute
to perform in certain contingencies
to be determined by the Court; the duties are
thus imposed under the
Ordinance upon this particular Office, not upon the Government.
and
upon
the same
principles
as in the case of Official Assignee,
I am of opinion that the
Government cannot be made legally responsible for
the wrongful
acts of the Registrar of the Supreme Court in his capacity as
Official
Assignee.
2 2 1
CA
The Office of Official
Assignee is an
Office
independent,
and the liability of the Government for the Registrar's
acts in that Office seems to be
neither more
nor less
than
it
would
be
for
that of
any
other person whom it appointed
to fill that post.
I think that the
same principle applies as in
the two former Cases.
