If I am right in contention, that what I am alleged to have done, has not incapacitated me from performing the work which I contracted to do, then the interdict is a breach of this contract, which discharges me from further performance, and gives me a claim for damages, which must be proportionate to the time I have to serve.
But apart from these considerations, the action of the Judges, to which I have already solicited the attention of His Excellency, has so altered the conditions and responsibilities attaching to the Office of Registrar, that it is no longer what it was when I entered into contract, and all further efforts of usefulness are completely neutralized.
It would not be becoming on my part, as a professional man who had undertaken duties such as I contracted to perform, to raise any of the questions before mooted, if the public interests required a contrary course, I would have done so.
