He knew that he would have to complain about the Doctor before and his first endeavour yesterday was to object to the latest change. He has become unusually scrupulous and considerate for the practitioners under him, since he left in 1878 with the option of doing his work himself or requesting assistance for a man to like his place who was well known to be quite unfit for the position. And I consider the objections he has made are simply frivolous excuses.

The following order of His Excellency on letter of 22nd of January 1880 from the Colonial Surgeon is communicated to him for his information and guidance.

I regret that Dr. Wharry should show a disposition not to carry out the Legge's instructions. I trust there may be no further delay in having the instructions of the Head of the Department carried into effect.

I have the honor to inform you that I am suffering from exhaustion from overwork and I am unable to perform my duties. I beg to request that I may be granted fourteen days' leave of absence and I shall be glad if you will be good enough to make arrangements for the carrying on of the works of the Hospital.

This is a most serious matter, and I must request that His Excellency the Governor will take the matter into consideration and if he should see fit to appoint a Board to examine into Wharry's case. I have to often had occasion to differ with Dr. Wharry on the subject of his being overworked and this is tantamount to an accusation of injustice on some part.
In the meanwhile I have no doubt I can procure the services of Dr. Marques who is a ... of Dublin to do duty during Dr. Wharry's indisposition.
