If I
I have been hitherto labouring under any misapprehensions as to my duties in reference to the Prison discipline book, with a view to investigating the legality of the punishments inflicted for previous offences, I find that I have shared it with the bulk of the impressions and the general opinion among the Justices that the book was kept rather for the information of the Executive, than for the instruction and guidance of the Justices.
My own opinion, and that of the general majority among the Justices, has been that the book was kept rather for the information of the Executive, than for the instruction and guidance of the Justices, and that it was laid before the Executive, at least on one occasion, when certain illegal punishments for previous offences were detected.
A Visiting Justice, Mr. Russell, was detected by a spurious list of punishments. It is worthy of note that Mr. Russell has received a legal training and was, at the time alluded to, a Police Magistrate and an ordinarily able and energetic man, and would therefore probably have at his finger ends notes relating to the punishment of crimes and offences, which to the majority of the Justices, each week, before sitting, would be comparatively rare.
