Mr W. M. Brown appeared for complainant, Captain Lionel Meltae, master of the ship, and said Frain signed articles as Second Engineer on November 19 for a period of six months. The ship returned from Shanghai on December 15, and orders were handed to the Chief Engineer for the ship to have steam up to procced to sen at 11 am, on December hand- 18. These written orders were hand ed to Frain by the Chlef Engineer.

On December 17, Frain accom- panied by Capt Meftae, went ashore to the Indo-China Steam Navigation Offices, where there was question at Frain signing off. It was eventually decided that Frain was to continue on the ship's articles until the end of six months and Frain was informed of this by Mr Lawson, the Marine Superintendent, that day. Frain was later seen having dinner on board the ship that evening, and that was the last time he was seen on board, At about 10.50 am, on December 10, Capt Mcitne boarded the ship, and was told by the Chief Engineer that Frain was not on board. The ship waited until 11.02 am. for Frain to appear and sailed with a supplemen fary engineer on board. Frain's gear was sent ashore in the agent's launch. Captain's Evidence
