of time not exceeding five years may by the same or any subsequent order under his hand fix the time for the departure of such person from the Colony.

Section 21 of 8 of 1858 it is provided that any Chinese person not finding security if required under that Section shall be deemed a person dangerous to the peace of the Colony within the meaning of Ordinance No. 9 of 1857.

The effect of the Ordinances taken together it appears to me is that apart from the Ordinance 8 of 1888 the Governor in Council has for the purpose of better securing the peace of the Colony absolute power to forbid any person not being a Subject of Her Majesty from residing in the Colony for five years.

This power has been given and exercised by H.E. Government under the peculiar circumstances of the Colony. The interference with the residence of aliens in the Colony is not nearly as great as that which exists in Gibraltar. No alien can enter Gibraltar without a pass and if he has ever been convicted of crime, he would not be allowed to enter if known.
