inquestionably of infinitely less value

than the five and an

Eighth acres

(colored red in the tracing) which the

Colony has recently relinquished to the Military Authorities, and which as His

Excellency The Governor well knows,

the most Eligible building

sites in the Colony, for Barracks or any

other class of Military Buildings.

11. But Even if the hill-top which overlooks the magazine, had happened to be a desirable site, it

would scarcely have been available as

the wise precaution imposed at the

time

of the transfer in 1868, against the Erection of houses of any kind within 200 Yards of the Magazine or Laboratory

is understood to apply to Imperial as well as

Colonial buildings.

12.

The

confusion that would be

created by the Military Authorities retaining lands to the South of the new road as is now proposed, would be

increased by the Colonial Authorities holding lands to the north of it, for if it is proposed to make the old hill-road instead of the road, the future boundary, in order to allow the areas colored green to remain War Department property, it

of course follows that there colored red revert to the Colony and the road ceasing

to be any longer a boundary, the object of

be frustrated.
