In sending the offenders to be
imprisoned at Hong Kong-
The Court could have treated the
Case as one of Common assault and
on the spot Sentenced the men to 12 weeks imprisonment-
under Section 18 of the Merchant Shipping
Act, 1855, and Section 243 of the Merchant
Shipping Act, 1854,
or
if it had treated it
as one of a murderous
assault it could
have sent the prisoners to Hong Kong
or
any other British possession for trial under
the 23rd and 26th Section of the Merchant
Shipping Act.
