I am to state that Lord Carnarvon

wishes to ascertain whether the

view taken by the Supreme Court

is

That the Ordinance in question

is within the competence

of the local

Legislature, but having

regard to the terms of the Law Officer's Report of the

17th October 1868, His Lordship

will be glad to be furnished

with

your opinion in conjunction with the

Attorney General upon the

question whether the local limit to its

jurisdiction over Chinese pirates is correct.

The Attorney General

submits the following questions:

1. Whether the answer

is proper which Lord Carnarvon

proposes to send respecting

The 22nd Section of the

Bill in question.

2. Whether the Jurisdiction

of the Admiralty extends to

acts of piracy committed

extra territorium, but by Chinese upon Chinese within

three miles of Chinese territory,

so as to make the perpetrators

punishable in the Supreme Court

under British Jurisdiction.

3. Whether the Admiralty jurisdiction extends to acts of piracy committed in such localities by foreigners other than

Chinese.

4. Whether it is competent

to the Colonial Legislature to
