The case against Thomas Peabody, John H. Snow, and Charles Stafford has not yet been closed, and cannot in justice be terminated until the evidence of the Captain and Mates of said vessel has been duly given at the Consulate. I have therefore to request that these men be allowed, if consistent with His Excellency's views, to appear at this Consulate, in proper custody, on Monday next, the 9th instant, to give their testimony in the case made against them by the complainants in the matter of the discharge of said seamen, if their application is to be granted, for "cruel and unusual treatment."
