to oppose their discharge. The United States Consul was represented by Counsel, as the Acting Attorney General declined to appear except for the defence. The Court reserved judgment.

9. On the 13th a further application was made to the Court for a writ of "habeas corpus ad testificandum" to take the prisoners to the Court Office, and I understand it was granted, but during the day the prisoners obtained bail with sureties and the United States Consul proceeded to the Consulate.

10. On the 16th Mr. Justice Innes discharged the rule as argued on the 19th, holding that the prisoners were properly in custody before the Magistrate and affirming every position that this Government had assumed.
