SEQUEL TO LOSS OF JUNK

INSURANCE POLICY

CLAIM

Arising out of the sinking of a trading junk near Sor Chau Island, a claim for $0,000 on an insurance bolley taken out in respect of cargoes | hipped on her was brought before the Chief Justice, Sir Atholl Mac- Gregor, in the Supreme Court this morning.

The Hon. Mr. Leo D'Almada, Jar., instructed by Mr. M. A. du Silva, appeared for plaintiffs, and the de- fendant company was represented by Mr. 11. C. Mirentinara, on the instruc- tions of Mr. W. A. Murkinlay, of Deacons.

Mr. D'Alimoda said the claim was on an insurance policy taken out by his clients with the defendent com- pany in respeel of 150 bags of cement and 750 sacks of manure shipped on Junk which had foundered. The premium on the policy had in fact! not been paid.

The plaintiff Arra consisted of two partners, Ho Shiu-nam and Leung Chiu. Ho was inure or less a sleep- ing partner until fairly recently, the management of the concern being left In the hands of Leung and one Lat Fing-kwan, who was the

manager. Shortly after the sinking of the junk, Ho had certain trouble with these two men, with the result that they were Int ΠΟΥ available to give evidence.

Plaintiffs were merchants, and deali fairly largely with the Lin Fat firm of Macao. Sametime towards the end of December, 1995, an order war received from them for the goods; mentioned, and the terms of payment ogreed upon were $5,000 on account and the balance to be paid on de- livery. On January 3, the cargo war put on board the junk, which was towed by a launch out of Hongkong at 5 pain that day.
