PROSECUTION

The netion brought by Chun Tam- kwai, an elder of Tai Tong village, ling Chau island, claiming $1,000 damages for alleged malicious
continued before Mr. secution was Justice J. J. Hayden nt the Summary Court this morning.
The defendants were Li Chan-shi, ulina Chan Yun, Tse Wong-shi, ufine Wong Mi-mooi, Tse Chan-shi, alias Chan Kan-fung, and the husbands of the first two, Li Tat and Tee Loi. All of them were inhabitants of Cha Tau village, Ping Chau island.
Mr. M. An Silva appeared for the plaintiff and the defendants were represented by Mr. W. A. Mackinlay. The claim was based on the allega- tion that the first three defendants. on October 4 last year, maliciously and without any reasonable or proper cause, preferred a charge of attempt- ing to obtain money by a false pre- tence against the plaintiff before a Magistrate, altting at Taipo, and caused him to be tried and imprisoned for one month. The plaintiff sub- sequently appealed against the con viction at the Court of Appeal, which quashed the sentence.
The defence was denial of malice in bringing the charge or that they initiated the prosecution.
The trouble, it was disclosed at the previous henring, arose through the refusal of the plaintiff to allow the defendants to remove sund from his village,
Li Chan-shi, the first defendant, who had given her evidence-in-chief at the previous hearing was cross- examined at great length by Mr. Silva. She said that when she went to the Tal Tong village on August to- 20 last year, the complainor, gether with another man named Li

Wals, demanded 50 cents from her ESSE before they would allow her to carry the sami.
She did not pay because she had no money, and the plaintiff took away her baskets. The plaintiff told heri that he had been instructed by We Government to demand the money, and pointed out to her a notice board to this effect. When the plaintiff snatched her baskets away, she took the notice board to her own village, for the purpose of verifying whether it was true or not. Subsequently, her village elders wrote a petition to the this District Officer (North) about matter. She had been suinmoned for taking the sand without a permit and was cautioned..
