This concluded, the case for the prosecution, al Mr. D'Almada then submitted there was no case to go to the jury against any of the recuse. He argued that there was no evidence on which the Cours could say there was common design not merely, to effect the robbery but to ennalt L with violence. There was nis no evidence as to who committed the smurder, and counsel quoted authori ties to support his contention that if there was no common design to commit a robbery with violence, the aegused should be acquitteet.
