I have the pleasure to assure Your Excellency that the alleged offence is not a felony; it could not well be so, for (excepting certain foreign laws) no Bankrupt or offence against the Bankrupt Law of the Colony, are more than misdemeanors and in offering the following remarks, I beg leave to submit that the Governor could not legally have surrendered the accused either in the case of Sam King Kong, or in the later case which formed the subject of telegraphic communication with Queensland.

I frankly admit that I was not aware of the Amending Act 16 and 17 Vic. C. 118; and my report on the case of Sam King Kong unfortunately appears to have been so worded as to convey to Your Lordship the impression that the man had been guilty of some offence amounting to felony in this Colony, and within the class of felonies triable at Quarter Sessions in England.
