I must inform Your Lordship that when I departed for England last year, a similar application was made to me by the Chief Justice for leave of absence for the latter summer, but I refused it on the ground that it was beyond my powers to grant it without reference to the Secretary of State, and I offered instead two months' leave of absence on half pay to be added to the two months' Vacation to which he was entitled; this, however, Sir John refused.
There is no doubt that the Judges as regards leave are placed at a great disadvantage in comparison with other Civil officers. Your Lordship is aware that the latter are allowed two months' "Vacation Leave" every year on full pay, or four months on half pay.
The Judges, however, are limited to the two months' Court Vacation in August and September, and even this is often times curtailed by the order that makes it imperative on a Judge to be always present in the Colony.
