The first mentioned car had been travelling along Prince Edward Road townrds Kowloon City and the other car had been travelling on Waterloo Road towards the Kowloon Hospital, when they collided at the Junction of the two ronds.

Fell Out of Car

A third car was coming along Princo Edward Road toward Mongkok and was also damaged.

After the accident Dr. Nicolson fell

out of his car and was injured.

Lee Man-yan, cashier of the Globe Trading Company, testified that about 10 p.m. on January 11 he was driving his uncle's car No. 3717 along Prince Edward Road from Kowloon City towards Yaunati. On nearing the beacon at the junction of Water- loo Bond witness saw a car coming from the opposite direction, and al- most at the same moment ho heard the sound of a horn. Then be kaw Waterloo a car proceeding alang Road towards the Kowloon Hospital from Kowloon Tong.

Witness, stopped about 25 yards | away from the beacon on the left site of the road about ten yards from the corner, because he wanted to turn left.

The car coming from Kowloon Tong seemed to be going faster than the car coming from Mongkok, but neither was travelling at, an ox- cessive speed. -

Immediately after stopping witness beard a crash and saw car No. 2643 turn round and end up in the left hand corner on the left of witness'e car. The other skidded and zig- zagged and collided with witness'a Amount of

damage. When witness saw the car coming towards him he put his ear Into, reverse gear in order to back away, but unfortunately was not in time,

Chi Yuen-sang. licensed driver of bua No. 689, deposed that both the cars were travelling at a normal speed and that they collided near the beacon near the centre of the road.

"Accidents Will Happen” Edward F. Bhes, clerk of the Cane- dian Pacific Steamably Company, de- posed that he was on bus No. 689 at the time. When he heard their driver exclaim: “As yah", ho suspected that something was wrong and loant to wards the window. The car coming from Kowloon Tong was travelling at ́a spoed between fifteen to twenty miles per hour. The other car was travelling about twenty-five miles per

hour.

After hearing the evidence of these witnesses his Worship, stated that be had not found one observation that could really sustain the summonsça against the defendants. Accidenta would happen and the witnesses seemed to be agreed that both the cars wero travelling at a normat speed, that was not fast. From the position of tho card, which was about | the middle of the road, neither driver: scomed to claim any particular right to the road.

His Worship thought that in the circumstances there was no prima facie caso against either defondant. The summonses were thereforé dia- mimed. ⠀ At the same timò, his-Wor- |ship sold the "would: like “tơ mention that the dismissal, of the summonses threw no reflection against the police,
