$25,000 CLAIMED BY HOIHOW RESIDENT
JUDGMENT GIVEN FOR $5,000 DAMAGES
General damages to the amount of $5,000 were awarded to Robert Roe Cuthbert, retired master mariner, of Hoihow, in a claim for $25,000 as damages for libel against the South China Morning Post, its General Manager, Mr. B. Wylie, and a third defendant, James MacPartland, of 105 Taipo Road, at the Supreme Court this morning.
The claim alleged that MacPartland was the author of a letter printed and published by the first and second defendants who, on their own responsibility, put on it the heading "And a Warning," which letter was understood to mean that plaintiff, by trickery, a fraudulently obtained monies for the avowed purpose of developing a mine knowingly and falsely alleged by plaintiff to be rich in high grade ore.
The plaintiff stated that he had been much injured in his credit and reputation by the publication of the words and claimed general damages of $25,000.
THE LETTER
The letter, which appeared in the S. C. M. Post on August 21. 1934 was as follows:
