A grim comedy of legal errors renched in climax here when court officials solemnly filed an appeal to save the life of a man hanged on April 4.
Rush Griffia, 19-year-old negro,' died on the gallows at San Quentin Prison, with an appeal-already perfected, which made stay of execution automatic-resting in files of a lower court clerk's office, apparently forgotten.
Mr. Richard F. Bird, Griffin's counsel, received first news of the negro's execution in newspapers. He promptly started an investiga- tion to determine what happened to the appeal, which he had filed with a transcript of the record.
The Court Clerk, C. K. Board- man, admitted the error, The. appeal, made legally offective two months ago so far as the defence could make It was still in his office.
