A further reference to the Act, however, under which the proceedings were instituted showed a point pointed out by the Attorney General to whom I referred the case that the 2nd Section of the Act in question limits the power to make such arrests to the Offences specified in Section 10.

The offence with which the ... and ... were charged did not come within the category specified. I had no option, in the opinion of the Attorney General, but to return the man his property,

release him, and inform the Government of the Straits Settlements that it was impossible to comply with their request.

There can be little moral doubt but that the man was guilty of the offence imputed to him, and that he owed his escape to the restricted character of the law applicable to cases of inter-colonial rendition, which, as the Attorney General points out in the memorandum which I have the honour to enclose, enables offenders to escape with impunity from one Colony to another when they have committed offences which
