Justice on the 22th of November the 4th 8th 11th 12th and 29th of December 1873 and on the 5th of January 1874.
Much evidence was taken, and argument made to establish that Annam is or is not a sovereign state, and that the Bangwere is or is not a public ship of that state; but no decision was given and the Chief Justice suggested that Counsel on both sides should deliver written arguments.
The argument of the defendants' Counsel having been delivered on the 22nd of January, the plaintiffs' Solicitors depose that the defendants' Solicitors almost immediately afterwards opened negotiations for a settlement. Eventually, after the argument of the plaintiffs' Counsel had been delivered, Counsel on both sides appeared before the Chief Justice on the 6th of March 1874 and consented to the following order.
On hearing Mr Henry Kingsmill Counsel for the Defendant and The Honorable Thomas Child Hayllar Counsel for the Plaintiff and by consent of the parties the Defendant protesting that his rights and status of an independent Sovereign prince are not affected hereby otherwise than for the purpose of this cause It is ordered That the attachment on the steamer shall be dissolved forthwith; That on the payment at Huey of the amount due by the Defendant to the Plaintiff all proceedings in this action shall be discontinued such amount to be ascertained at Huey; That on the payment of the ascertained amount, the Plaintiff shall pay the Defendant's costs in this suit; That the amount due be ascertained within 3 months and the ascertained amount to be paid within 6 months such time to date from the date of this order; That if the amount found to be due shall not be ascertained and...
