Captain Jacobsen" was charged with having (a) on February 27 wilfully given false information to the Harbour Master when ap- plying for a port clearance by stating that there were no pas- sengers when in fact there were 40; (b) left or attempted to leave port after having obtained a port clearance with 40 passengers, the number being greater that that allowed on such a clearance;' (c) unlawfully carried or attempted to carry 40 passengera on a voy age to Swatow without a scarch being made of his vessel.
Mr. M. M. Watson, appearing for the defendant, pleaded not guilty to the first charge, but ad- mitted the second and third.
Sub-Inspector Rézeskwy, pro- secuting, said that on February 27 the water Police station received a list from the Harbour "Ofée showing the number of ships which, had cleared with passen-. gers. The Gustav. Diederichsen was not on that list. On making Inquiries at the Harbour Office, he was informed that the Gustav Diederichsen had cleared with no passengers. At 9.25 am, the fol lowing day, Messrs. Jebsen & Co... the agenta for the owners of the vessel. telephoned the Water Police saying that the ship had been pirated, certain people kid- napped, and the Chief Omeer. wounded.
