Other Objections. Objection was further taken by Mr. Le to the form in which the next questions was put, implying that the witness had admitted having himself
the prepared balance sheet on which he was being cross-examined.
Following further argument, Mr. Schofield agreed to note Mr.. Los objection, that "it is open to ques tion whether up to this stage there in evidence to show that the wit- ness has himself prepared the balance sheet in question, and if he
has
not himself prepared such balance shact whether these ques- tions are permissible in regard to a matter on which he had no personal knowledge, although he may have been the manager and was in con- trol.'
Mr. Lo accused Mr. D'Almada of being unwilling to take the risk of putting the direct question to the witness.

In further cross-examination, Chan Cho said he did not sign the balance sheet, nor did he chop it He had not examined the entries in detail; he only examined the totals and accepted them as correct they appeared on the balance sheet. A total of $108,000, he said. was remitted to Hongkong on account of deposits. An item of $16,000 under this head included $2,000 handed to defendant at his own re- quest and when he complained ho was sick.
