Checking System.

Mr. Leo intimed that he WA going to oppose such application by Mr. Loseby. He argued that each case was dependant on its own merits, and in any circumstance, the discretion always remained to the Magistrate of dealing with the case summarily or sending it up to the higher Court.

After some discussion, his Wor- ship said he would take the evid- ence as for committal in the ordin ary way, and in reserving to lilin- self his discretionary power, would consider the question of committal or otherwise at a later stage.

Evidence was then called, and Det. Sergt. C. T. Byron gave formal testimony regarding his arrest of the accused on a warrant.
