relating to the law Points governing deportalion orders were raised by Mr. R. E. Lindsell, assistant Attorney-General at the Criminal Sessious this morning before the Chief Justice, Зоверь Кетр
Mr. Lindsell said the position at present was that the ordinances of 1017 laid down certain pro- cedure by which allens and others could be banished from the colony. The practice seemed to have arlsen in the past ten years in dealing with deportations that where a deporteo, against whom

order of the Governor-in- Council was still current, returned from banishment and was found in the colony, and no other offence proved against him since his co- turn, he was merely automatically re-banished under the terms of the old order. If a man returned in 1930 after being banished for ten years in 1925 and no other offence was proved against him, he would merely be sent out of the colony again and told he could be charged with returning,
If such a person returning in 1930 committed shop-breaking and sentenced both for that was and for returning from banish- ment on discharge from prison he order under would find a new which he would be re-arrested und no doubt expelled. There was about the legality of the procedure in the latter case, but the difficulty the Crown felt it was in, at present, was whether or not it might be held that the prisoner who return- ed during his term of banishment thal and served sentence for breach of the deportation order to have done might be held.

The other paint was whether a man, on his return under the original order, might also be law- ful and whether the action of the police in arresting such a prisaner on his discharge from gaol with- out any new order was irregular?

His Lordship: The order is, of course, an order prohibiting the deportes to live in the colony for cortain lime. I think if deporice returns and is arrested and sentenced and then leaves the colony and returns a second time. further is 24 the second return offenco. The other point does not really arise in these cases. I do not know of any power to banish forcibly a prisoner who has just Berved a term for a breach of a deportation order. It is true the ardor prohibits him from being in the colony and it is his duty to make his way out of the colony as soon as possible after release from #Rol."
