The Principal Defence. When the Court resumed its sit- ting in the afternoon, Mr. Frank lin said that the principal defeare was that five years elapsed bo tween the trial in Tientsin and the Aling of the motion for a new trial. None of the grounds upon which plaintiff based his application existed immediately after the trial anil, under the circumstances, there was an excuse for plaintiff's failure to file his metiða for a reg trial within the period of one year as prescribed by law.

The Judge, in adjourning the hearing and warning: plaintiff to be ready to reply, told Mr. Frank lin to cite authorities to show whether or not a judgment could be vacated and a new trial granted after the lapse of such a lengthy period as in the present ease.
