Regulations and Penalties.

XXXVII. In addition to the powers hereinbefore given, it shall

2. In any regulations under this Ordinance, except with reference to quarantine, it shall be lawful for the Governor in Council to impose penalties for the breach thereof, but so nevertheless that the penalty for the breach of any such regulations do not exceed two hundred dollars or six months imprisonment with or without hard labour.

3. All offences against this Ordinance, or any regulations made Recovery of penalties and thereunder, except when otherwise provided, may be heard and determined by any Stipendiary Magistrate, and all penalties imposed by and expenses recoverable under this Ordinance, or any regula- tion made thereunder, except when otherwise provided, may be recovered in a summary way before any Stipendiary Magistrate. 4. Whosoever, with intent to defraud, shall forge or alter, or shall offer, utter, dispose of, or put off, knowing the same to be forged or altered, any certificate, ticket, document, matter or thing named in this Ordinance, or any regulation made thereunder, shall be guilty of felony, and being convicted thereof, shall be liable, at the discretion of the Court, to be kept in penal servitude for any term not exceeding seven years, and not less than three years, or to be imprisoned for any term not exceeding two years, with or without hard labour.

XXXVIII. The fees specified in tables marked B, C and D of the Schedule hereto are hereby declared to be payable to the Har- bour Master as the lawful fees for the discharge of the respective duties therein specified, and the same and all other fees payable under this Ordinance, or any regulation made thereunder, may be re- covered in a summary manner before any Stipendiary Magistrate.

2. All such fees shall be paid into the Colonial Treasury to the use of Her Majesty.

An abstract of such portions of this Ordinance as the Governor in Council may direct, shall be delivered to the master of every vessel upon her entering the waters of the Colony; and every vessel. if before obtaining clearance, the master do not return such abstract to the Harbour Master, he shall pay a fee of one dollar for the same.

But this repeal shall not revive any enactment repealed by any

of the said Ordinances or sections, and shall not affect :-

(1.) Anything duly done before this Ordinance comes into

operation;

(2.) Any right acquired or liability accrued before this Or-

dinance comes into operation;

(3.) Any penalty, forfeiture or other punishment incurred or to be incurred in respect of any offence committed before this Ordinance comes into operation;

(4.) The institution of any legal proceeding, or any other remedy for ascertaining, enforcing or recovering any such liability, penalty, forfeiture or punishment as aforesaid; (5.) Any regulations made and published by the Governor in Council, under any of the Ordinances hereby repealed, and not expressly repealed by this Ordinance or by any regulations made or to be made thereunder.

Suspending Clause.

XLI. This Ordinance shall come into operation on a day to be hereafter proclaimed by the Governor.
