NO. TRANSFERENCE OF POSSESSION.

DECIDED BY BENCH AS NOT

A TRANSACTION.

A legal technicality, concerning the wording of the Ordinance, yes- terday caused the collapse of a case nf child-trafficking brought by the Secretariat for Chinese Affairs before Mr. Lindsell at the Central Magistracy,

A woman, named Ch Yee, was charged with, that on January 7, at No. 314, Queenin Road Central, she took part in a transaction the object, or one of the objects of which, was to transfer the posses aten, custody or control of a four- year-old boy, Chan Sang, by her to ono Lo Sal Ping, another woman, for the sum of $370.

The relevant Section was 48 a, Ordinance No, 2, of 1865.

Evidence adduced by the pro- secution showed that Lo Sai Ping, an informer, was sent by the police to the floor, where she bargained for the sale of the child, the trap being made complete with the securing of what was alleged to be deed of permanent presentation. A statement signed by Chan Yee after she was arrested and charged, contained an admission of the transaction.

"Cambay Buildings".

For the defence, it was pleaded by Mr. F. H. Losoby that since the transaction was a trap, and there obviously was no intention on the part of the Informer and/or the police to obtain possession of the child, the transaction lacked the "object" specified in the ordinance. The transaction, it followed, was not a bona fide one, and he sub- mitted that the accused had no case

to answer.

Inspector J. Murphy, for the Secretarint, argued that the inten- tion at least was there on the part of the accused sell the child.

His Worship, agreeing with Mr. Loseby, replied that the law as it stood at prescut, did not say any thing about intention.

In discharging the woman, his Worship pointed out that he was not disbelieving the evidence of the simply that prosecution. It was the law did not seem to provide for that sort of case, where an informer had to be employed in the truna nction.

asked for Inspector Murphy guidance regarding the disposition of the child concerned.

His Worship replied that there being no transaction with the ob fect specified by the Section, there

no buyer. It

the Was for Secretariat to concern itself with what was to be done with the child.

CAT FOR CRIMINALS.

OPINION OF A FORMER HONGKONG WARDER.

Л

Pointing out that the cat-o'-nine- tails is used in Hongkong as method of punishment for certain type of criminals and has proved highly effective in reducing crime in the Colony,, Mr. W. J. 3. nat. former principal warder at Hong kong, endorsed the assertion made by Mr. Stirling Fessenden, director general of tho Shanghai Municipal Council, to the effact that the ro of the "eat" there would greatly dearoase crime.

In a statement made to a repre- sentative of The Shanghai Erning Post and Mercury, Mr. Gast declar ed that if the "ent" in restored there will be an immediate decrease in pemed kidnappings, armed rob. borios and other orinion of violence. "I base my statement," he said, with experience Fictital mirals: on facts, not theories. A
